Terms of Service

Please read these Terms of Service carefully. These Terms govern your access to and use of the UnmuteUSA website and any online storefront, features, or services operated by UnmuteUSA LLC (collectively, the “Site”), and your purchase of products offered through the Site. By accessing the Site, creating an account if that functionality is available, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or place an order.
1. Eligibility and Changes to These Terms
You must be able to form a legally binding contract to use the Site or place an order. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization. We may update these Terms from time to time. The version posted on the Site at the time of your order will govern that order, except to the extent applicable law requires otherwise.
2. Products and Product Information
UnmuteUSA offers educational content, decorated apparel, accessories, drinkware, stickers, and related merchandise (collectively, “Products”). Product availability may change without notice. We try to describe and display Products accurately, but colors, dimensions, print placement, fabric texture, and other characteristics may vary because of screen settings, manufacturing tolerances, and decoration processes. Minor production variations that do not materially affect the Product are not defects.
Some Products may be produced or decorated after an order is placed, including through third-party production and fulfillment providers. We may discontinue Products, limit quantities, or refuse or cancel an order where reasonably necessary, including because of availability, suspected fraud, pricing or description errors, or suspected resale activity. If we cancel an order after payment has been collected, we will refund the amount collected for the cancelled portion.
3. Orders and Acceptance
An order is an offer to purchase the Products identified in the order. Receipt of an order confirmation does not necessarily constitute acceptance. We may accept, decline, or cancel an order before shipment or production where reasonably necessary. You are responsible for providing complete and accurate billing, shipping, and contact information.
Because some Products may enter production shortly after an order is placed, cancellation requests are not guaranteed. Contact us promptly at info@unmuteusa.com if you need to request a cancellation. If production or fulfillment has already begun, we may be unable to cancel the order.
4. Prices, Taxes, and Payment
Prices are shown in U.S. dollars unless the Site states otherwise. Applicable taxes, shipping charges, and other charges will be disclosed at or before checkout. We may correct pricing, typographical, or other errors and may cancel an affected order, in which case any amount collected for the cancelled order will be refunded.
Payments are processed through Stripe. Available payment methods may include major credit cards and, when offered at checkout, Klarna and Affirm. Availability of a payment method may depend on your location, eligibility, the amount of the transaction, and the payment provider’s terms. Klarna and Affirm may provide financing or installment-payment options under separate agreements between you and the applicable provider. UnmuteUSA is not a lender and does not determine eligibility for those products.
5. Shipping and Delivery
We ship only to destinations made available through the Site at checkout. Available destinations, carriers, shipping methods, and charges may change from time to time. You are responsible for providing a complete and accurate delivery address and for charges disclosed at checkout.
Shipping and delivery dates are estimates, not guarantees. We are not responsible for delays outside our reasonable control, including carrier delays, weather, supply interruptions, customs processing, or incorrect delivery information supplied by the customer. Risk of loss passes to you when the Product is delivered to the delivery address you provided, except where applicable law provides otherwise.
6. Returns, Refunds, and Product Issues
Except where the Site expressly states otherwise at the time of purchase or applicable law requires otherwise, all sales are final. We do not accept returns or exchanges because of change of mind, preference, or an incorrect size selected by the customer. Please review Product descriptions, sizing information and terms upon checkout carefully before ordering.
If a Product arrives damaged, defective, materially different from what you ordered, or incorrectly produced, contact info@unmuteusa.com within 14 days after delivery. Include your order number and reasonable documentation of the issue, such as photographs when appropriate. For a confirmed issue, we may provide a replacement, store credit, or refund, as appropriate and subject to applicable law. We may ask you not to return the affected Product or may provide return instructions. Do not send a Product back unless instructed to do so.
Refunds, when issued, will generally be made to the original payment method. If you paid through Klarna or Affirm, the timing and manner of any adjustment may also be subject to the provider’s procedures and agreement with you.
7. Accounts and Electronic Communications
If the Site offers account functionality, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly if you believe your account has been accessed without authorization.
We may send transactional communications relating to orders, customer service, security, or the administration of your account. If we offer marketing email or text-message programs, marketing communications will be sent in accordance with the choices presented to you and applicable law. You may opt out of marketing communications using the method provided in the message, but you may continue to receive non-marketing communications relating to transactions or your relationship with us.
8. Intellectual Property
The Site and its content, including text, graphics, product photography, artwork, logos, trademarks, slogans, page design, and software, are owned by UnmuteUSA or its licensors and are protected by applicable intellectual property laws. UNMUTE™, UNMUTE DEMOCRACY™, and A BETTER VISION FOR AMERICA™ are marks used by UnmuteUSA. No license is granted except the limited right to access and use the Site for personal, non-commercial shopping and informational purposes.
You may not copy, reproduce, modify, distribute, publicly display, scrape, frame, mirror, reverse engineer, or commercially exploit Site content except as permitted by law or with our prior written permission.
9. Acceptable Use
You may not use the Site to violate law; infringe intellectual property, privacy, publicity, or other rights; transmit malware or harmful code; interfere with Site security or operation; attempt unauthorized access; submit fraudulent information; use automated means to place abusive or fraudulent orders; or engage in conduct intended to harm UnmuteUSA, other users, or third parties. We may restrict access to the Site or cancel orders associated with prohibited conduct.
10. Third-Party Services and Links
The Site may rely on or link to third-party services, including payment, fulfillment, shipping, hosting, analytics, and communications providers. Those third parties may have their own terms and privacy practices. UnmuteUSA is not responsible for third-party websites or services that it does not control, except to the extent liability cannot be excluded under applicable law.
11. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect personal information in connection with the Site and is incorporated into these Terms by reference. If these Terms and the Privacy Policy address the same privacy issue inconsistently, the Privacy Policy controls with respect to the handling of personal information.
12. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES REGARDING THE AVAILABILITY, SECURITY, ACCURACY, OR ERROR-FREE OPERATION OF THE SITE. PRODUCTS ARE SUBJECT TO ANY EXPRESS PRODUCT DESCRIPTION OR REMEDY STATED ON THE SITE OR IN THESE TERMS, AND OTHERWISE TO WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED.
Nothing in these Terms excludes or limits any warranty, remedy, or consumer right that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain warranty disclaimers, so portions of this Section may not apply to you.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UNMUTEUSA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE SITE OR PRODUCTS, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, UNMUTEUSA’S AGGREGATE LIABILITY FOR CLAIMS ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO UNMUTEUSA FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR PERSONAL INJURY TO THE EXTENT CAUSED BY OUR NEGLIGENCE.
14. Indemnification
To the extent permitted by law, if you use the Site for commercial purposes or on behalf of an organization, you agree to indemnify and hold harmless UnmuteUSA and its officers, employees, and agents from third-party claims arising from your unlawful use of the Site or your material breach of these Terms. This Section does not apply to ordinary consumer purchases for personal, family, or household use to the extent prohibited by applicable law.
15. Force Majeure
We are not responsible for a failure or delay caused by circumstances beyond our reasonable control, including natural disasters, fire, severe weather, governmental action, war, civil unrest, epidemics, labor disruptions, carrier interruptions, supply shortages, telecommunications failures, or failures of third-party service providers, except to the extent applicable law requires otherwise.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except that mandatory consumer-protection laws of your jurisdiction may also apply. Before filing a lawsuit, you and UnmuteUSA agree to make a good-faith effort to resolve the dispute informally by written notice and allow 30 days for a response.
Subject to any non-waivable right you may have to bring a claim elsewhere, any judicial proceeding arising out of or relating to these Terms or a purchase from the Site will be brought in the state courts located in Alameda County, California, or the federal court with jurisdiction over Alameda County, California, and each party consents to those courts’ personal jurisdiction.
17. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, or similar transaction, provided that doing so does not reduce any non-waivable consumer right. These Terms, together with the Privacy Policy and any terms presented at checkout for a specific promotion or payment method, constitute the agreement between you and UnmuteUSA regarding the matters they address.
